Suppose the potential litigant is a citizen challenging the legality of conduct by the PDC. Does the public interest of openness trump the need for secrecy of an Executive Session that is intended to get a tactical jump on a litigant? There is this notion that the conduct of elected officials, when doing something unlawful, might not be criminal it it is done in good faith upon the advice of counsel. Open the doors . . . unless you got something to hide, like bad faith.
